Detained DACA Recipient Released, But Dreamers Still At Risk

Vargas' parents brought her from Argentina when she was 7 under a visa wavier program, which allows immigrants to enter the US without a visa for 90 days but denies them a hearing in front of a judge if they overstay.

According to the Huffington Post, Vargas, who dreams of becoming a university-level math professor, is under "order of supervision", which means she will have to check in with Immigration and Customs Enforcement periodically.

Vargas was being held at the LaSalle Detention Center in Jena, Louisiana, and was under threat of expedited deportation, until her surprise release around noon on Friday.

"We are overjoyed by the news of Daniela's release", Vargas's immigration attorney Abigail Peterson said in a statement.

Her attorney, Nathan Emmons, said that Vargas' earlier Deferred Action for Childhood Arrivals status had just expired and that his firm had already filed to renew it. DACA immigrants are people who were brought to the country by their parents when they were young children - often referred to as "Dreamers".

She said the events "sharpens the question".
